A disgruntled PlayStation 3 owner in Florida has filed a class action lawsuit against Sony, claiming that a firmware update made live in early September caused PS3 units to "malfunction and actually damaged the hardware on many units." The suit claims Sony is charging $150 to repair PS3s with "sustained hardware damage" from the update.

After some early reports of a problem with update 3.0, Sony issued a fix, but the Florida man claims Sony's update doesn't actually correct the problem. In fact, he says the "fix" actually caused further problems with the console's Blu-ray drive.

The suit accuses SCEA of breach of implied warranty, negligence, negligent misrepresentation, unjust enrichment, and other counts. The suit is seeking restitution, unspecified monetary damages and legal fees. As of yet, Sony hasn't commented on the matter.

Although I've read a few scattered posts on the internet about the issue, my PS3 is fine, and no one I know has had this happen to his or her system either -- G4 has a lot of PlayStation 3 owners, too. Still, there are scattered reports on the internet, and a guy in Florida is angry enough to sue, so maybe there is something to this.

What do you think? Have you experienced this problem at all? How about anyone you know?

    my, ps3 broke about a month ago, i got the yellow light of death and was slaped with the $150 repair fee

    Nope, no problems here. I kno abt 6 ppl with PS3's and none has had any problems either... Is this a case of, 'I sue you because i can'?

    I haven't had any problems with my PS3 since the update nor do I know of anyone having one besides this guy in Florida. Me thinks this guy broke his PS3 and wants a new one for free and a little extra. Or he could be legit, but I doubt he'd win in a court of law.

    Had my BD-Drive fail after only 9 months of ownership, Sony replaced drive under warranty no-problems, and (with proof-of-purchase) no questions asked. No update PS3 or Game has damaged my system.

    Yea...if an update SOMEHOW caused hardware damage I can guarantee you'd hear more than one idiot in Florida about it.

    My PS3 is still workin fine, same with everyone I know that owns one, I have on of the original PS3's with the 40gb hard drive, never had any problems *knocks on wood*

    No problems at all here. Everyone I know with a PS3 has had no problems either, but everyone I know with an Xbox, well..............you know.

    I haven't been able to long into home once since update 1.3, it always freezes up on me. I may need to re-install it but I don't have any problems past that.

    Ahem. *raises hand* I had the same feeling this guy did but how in the hell can you prove something like that. I think it has to do more with overheating than any thing else.

    No one in my 20 person clan has had any problems with the ps3 after 3.00. It was probably just that he was one of the 5 to 10% of the people whose ps3 happened to fail.

    He doesnt have a case in the terms of agreement for the update you have to say i wont hold sony responsible for any damages sustained in the update

    YEAH this crap happened to me right after the damn update but I was lucky to have just gotten paid so I could repair it right away and I was planing to do something speacil with that money for my gf but now I had to go into my fliping savings this also happen to 2 of my cousin's and my best friend all right after the damn update sony is trying to rob us man that why I like my xbox better even thought micrsoft does its fair share of rip off's

    YES, this problem pertains to me. I am an adult, who used our playstation mostly for watching blu ray movies, a few times a week. Have taken very good care of it and is barely over a year old.
    After purchasing 2 brand new blu ray's we watched the first one in it's entirety, then browsed the PS Store which forced the update. Then went to watch our 2nd brand new movie and 5 minutes into it, it froze. Now our PS3 does not read any discs.

    All you people out there who are saying 'No, it hasn't happened to me' Well, good for you. But if it had happened to you I think you'd have quite a different stance. The fact is, it happened to a very small portion of PS3 owners. There's no doubt about that, but the thing is, it was Sony who caused this with their firmware. Many argue this is not possible. Ah, but it is. I'm not an engineer, but have read up enough to know that the firmware contains an update that tells the discs to read faster and this forces some people with older hardware that is not capable of reading that fast to brick. The thing that's irritating is that it's SONY'S FAULT this has happened and they are not acknowledging it in any way.

    Good for this guy for filing this lawsuit. If there is a way to hop on board, I'm in.

    YES!!!!! this is the SAME thing that happend to me.

    i got it repaired twice. once for the bd drive the second for my hard drive. AND NOW THE THIRD is the same problome. and it just so hapens that i was 3 days over the warrenty when it happend

    The guy is probobly poor, so hes trying to make an excuse to sue and make a quick buck, most likely doesnt even have a job. Plus, he cant make a case outta this, its too flat, No real proof, he gave no word to if he even tried re-installing software and such to see if that fixed his ps3. He's most likeley a hacker too, he probobly did something stupid to his PS3 and it messed it up, so hes blaming the update for his problems. People these days...really...
