First Amendment Attorney Rips California's Proposed Anti-Violent Video Game Statute

Remember back in May when California managed to get its anti-violent videogame statute (which was signed by governor Arnold Schwarzenegger and then found to be unconstitutional by five separate court rulings) onto the docket of the United States Supreme Court? Well, we’re still waiting to hear what the highest court in the land has to say about it, but in the meantime, here’s a rather amusing take on the whole ordeal.

As GamePolitics reports, First Amendment attorney Robert Corn-Revere recently told Broadcasting & Cable, “In 2009, the killer cyborg turned governor has materialized in the present from the past in a plot to undermine the First Amendment.” (Is it me, or does that sound like a sweet game plot?...No?...It’s just me?....Fine. Jerks.)

Corn-Revere continued:

“In seeking review, California is asking the Supreme Court to reverse 60 years of First Amendment jurisprudence and to hold that 'excessively violent' material-whatever that may be-'deserves no constitutional protection.' It is also asking the Court to relieve government from actually having to demonstrate the purported harmfulness of speech it seeks to regulate, but instead to defer to ‘reasonable inferences’ and legislative judgments.”

“If California is successful, it will open the door to regulate not just video games, but a wide range of speech that is currently protected under the First Amendment.”
 
Good thing there isn’t a lot riding on this SCOTUS decision. Sheesh. Although, given how unsuccessful the law has been thus far, it doesn’t seem likely that those previous decisions will be reversed, especially considering the law’s utter lack of facts, data or, you know, constitutionality.
 
P.S. I recommend checking out the latest episode of Penn and Teller’s Bulls*&$#, since they take on videogame violence (disbarred attorney Jack Thompson even makes an appearance) with hilarious/sad results.

    ya, i watched the pen and teller episode when they discussed violent video games...the ending did make me very sad

    it really pisses me off when people try to ban or change laws for games i mean first grand theft auto now this man its just a game but little kids just have to copy what they see even the rating system is such a hastle i mean if you want to get a strategy guide for halo 3 u need an adult which is even more pointless

    I'd have to read exactly what this bill entails, but if it is limited in scope ONLY to restricting the access of violent video games to minors, then I have absolutely no problem with it and think Arnold and company should be commended for it.

    i love how video games continuously are targeted as being "too violent" yet over 3000 children and teens are killed every year by gun violence...

    from what i can tell GUNS are more of a problem than video games no matter how you look at it. For example, how many people have LITERALLY been killed by video games? 1 if you count that chinese guy that didnt eat/sleep for like 3 days

    not that i have a problem with gun ownership but i think this country has more serious concerns than unwarranted gaming litigation

    Personally...I'd rather have kids/teens at home wasting pixilized aliens, driving at insane speeds and throwing punches with their friends in the comfort and unreality of their own homes than out in the real world. C'mon Ahnuld, don't you have more things to worry about in California than this...ummm how bout the fact that your state is BANKRUPT!!!!! leave the games alone and focus on what's important...Cali's economy and making sure Maria doesnt leave your bedroom satisfied.

    just change Mature to Adult rating, so parents dont buy it for kids that its not intended for. how many parents buy porn for there 8 y/o?its the ill informed parents and retailers in the situation thats buying and selling the games and then saying its warping kids minds. it just a good reason of some one to hate on something. games dont hurt kids parents hurt kids.

    i love videogames probably more than anyone here but guns arent the point. the stupid government thinks that videogames+kids= violent influence, and most games that dont do that but are wrongfully of accused of are shooters, so they think the kids use guns because of thaeir favorite fps, but it's really the stupid kids dumbass fault for playn with the gun in the first place.

    If someone regulated video games and it's no longer protected by the 1st Amendment, then think about what would the government would hit next. Next would be movies, then newspapers, magazines, assemblies, and speeches. This would end up being, like what, the first step on the road to socialism and the discovery of America to become obsolete.

    Parents should look over and monitor what these kids watch/play. Sometimes it's their fault that the government could be stepping in. Also they need to tell their kids that the game might not be suitable for them at that age. They might whine, scream, or complain, but they will soon get the message. These crimes committed everyday don't stem off of video games; It's the person's decision to do the crime or not.

    Government needs to back off. We are protected by the first amendment and there's nothing anyone can do about it. Do something more productive and less provoking like, I don't know, the ECONOMY we're in. Unemployement is at 9% and count and you are going to concentrate on video games?

    It sickens me that they would put so much effort into "regulating" videogames when there are bigger problems at hand, like the economy. If this idea had passed, if people were that short-sighted and narrow minded, think of the games we probably couldn't play: Grand Theft Auto, Halo, Super Smash Bros., God of War, Assasin's Creed, just to name a few. Also if this passed through, then videogames might not be the only ones being regulated. Newspapers, assemblies, and other forms of expression would be regulated, leading us to a possible destruction of the First Amendment and the first leg on the Socialist Decathalon.

    Parents, it's up to you to check out these games before you let your children play them. Do your research, talk with your children. Sure they might whine, complain, or cry, but they will soon get the point. Personally, I don't think that games contribute to violence, but hey, government would beg to differ. Try to come up with 5 instances of video game related fatalities. Thought so...

    god another attempt to control children just because our age is lower then yours doesnt mean you can pin every thing on us seriously pick on someone your own size stop controling us you say we are to immature you know why were to immature because you and the government wont let us grow up im 15 years old i have adhd and every one automaticly thinks im a out of control teenager i cant drive i cant vote i cant buy a good movie i cant buy pretty much any game thats good i cant buy spray paint to finish my school project i cant even buy glue for school and the cussing thing so what its a word that someone felt should make it bad word honestly its a word it doesnt mean anything but you adults feel the need to control us kids and it pisses me off you think we dont see violence or sex look outside im sure you can see something that has to do with that hey you can turnn on the news and there you go there is 24 hour violence our schools teach us violence but thats ok as long as we dont have fun while seeing it cuz if we are having fun shooting aliens or eneimies on call of duty or medal of honor thats bad for us and teaches us violence i think it bs i hate bein told what to do just cause im a kid and gambling well you say were not old enough because well just spend all our money what about all those people that go and spend all of their money and their kids money and wifes money and their kids college money but thats not the same because he has been on earth for 21 years so if you control what games we play even more ill have to think that every thing that we learned about the U.S bein free and a democracy is bull oh and we cant even vote like what the hell we live here to i think we deserve to decide our futures to so please everyone that reads this be nice to us kids we are people to we deserve everything you have too oh and california good luck you guys arnt going to last very long so thank you for listining

    I tried to get Metal Gear Solid 2, but I couldn't get it because I didn't have a parent with me.
    In the same mall, I got Postal: The Movie. It was Rated-R. They didn't even ask me for an ID.

    So, its okay for me, a 14 year old minor, to buy a movie that makes fun of 9/11, has onscreen child murder, Verne Troyer raped by monkeys, and Dave Foley's penis, but when I try to buy a game that has a few blood effects, I get the Governator on my ass.

    The irony of this situation? "Postal: The Movie" came with a M-Rated video game, "Postal 2!"

    Kids will always watch/play/see what they re not supposed to. It s part of growing up. We ll continue to get free refunds from hookers in GTA, just like how kids watched The Terminator as a kid, and not even Jack Thompson or the Governator is going to stop us, so long as Free Speech prevails.
